The Makeup Box Ltd (TMB) Terms and Conditions for Advertising Clients and Members
The ‘Makeup Hub,’ is themakeupbox.com ‘Global Online Directory’ for members of the makeup industry wanting to advertise makeup products, makeup brands and services, makeup orientated websites, makeup products, medical and remedial makeup products and services, film and special effects makeup companies, body art, nail art, tattooists, hair and wig making services. (‘spa’s, beauty salons’ and’ hair studio’s on the provision these businesses sell makeup products and/or offer a full makeup service on their premises.) makeup schools, makeup agencies, makeup artists, makeup magazines, makeup marketing organizations, online and high street makeup retailers selling makeup products, makeup accessories, makeup equipment. For an annual subscription fee, ‘Themakeupbox.com’ will sell members of the makeup industry, wanting to advertise in ‘The Makeup Hub,’ a Picture Link, Hub Portfolio and Hub Portlet, each of these products can be linked to an existing website, provided the website promotes, sells or advertises makeup products and/or makeup services. ‘Standard and Premium Banner Advertising’ is commissioned on a monthly basis.
‘Makeup and Bridal Services,’ is the makeupbox.com ‘UK and Ireland Online Directory’ for independent makeup artists, hair stylists, photographers and wedding film specialists wanting to advertise a mobile wedding business. For an annual subscription fee Themakeupbox.com will sell Wedding Portfolio’s and Wedding Portlet’s to clients wanting to advertise in ‘The Makeup and Bridal Services Online Directory,’ each of these products can be linked to an existing wedding related website. ‘Standard and Premium Banner Advertising’ is commissioned on a monthly basis.
‘TMB Advertisers Approval Service,’ once payment has been made in full an editor will look and review all client information, advertising copy, pictures, external links and websites submitted to TMB for inclusion in ‘The Makeup Hub or Makeup & Bridal Services Online Directories,’ TMB will contact potential clients by email and inform clients whether the content of their advertisement and/or web site has been approved or rejected within 24 hours (excluding public holiday periods observed by TMB)
On approval a clients Picture Link, Hub Portfolio, Hub Portlet, Wedding Portfolio, Wedding Portlet will be visibly online within 24 hours and if requested linked to the clients website (TMB, its subsidiaries, employees and agents, shall not be liable for any loss of business, loss of data, interruption of business that result in any way from applicants inability to use this service.)
If a business is rejected an applicant is entitled to request an appeal by sending an email. TMB must receive the applicant’s email within thirty days from the date that TMB transmits the rejection email to the applicant. If the request is timely received TMB will again review the applicant's business and no additional fee will be charged, we will notify applicant of TMB’s final decision. If TMB reaffirms its denial of the site, no further appeals or submissions will be considered and the subscription will not be refunded.
‘Linking a Website to themakeupbox.com,’ websites will be reviewed by the ‘Advertisers Approval Service’ before being submitted in ‘The Makeup Hub or Makeup & Bridal Services Online Directories.’ Websites must not contain any sexual content, products, services or other information that may be illegal to sell under any applicable law, that may infringe or violate anyone's rights, or that, TMB believes, in its sole discretion, is offensive. Websites must be linked to themakeupbox.com via a ‘Picture Link, Hub Portfolio, Hub Portlet, Wedding Portfolio or Wedding Portlet.’ Websites must be up and running 24/7. Websites must sell makeup related products and/or services. Websites must support multiple browsers and capabilities. ‘TMB reserves the right to list your website in any category or subcategory in ‘The Makeup Hub or Makeup & Bridal Services Online Directories,’ as TMB deems appropriate, TMB reserves the right not to include any specific keywords in the title or description of your website.
‘Third Party Sites,’ TMB does not endorse the content on any third-party web- site, including its members or affiliates. Your use of Third-Party Sites is at your own risk and subject to the terms and conditions of use for such sites.
‘Conditions of Payment,’ clients must submit a valid credit card number and agree to this credit card being charged for advertising on ‘themakeupbox.com’ website. Credit cards will be charged the recurring annual fee for continued inclusion in ‘The Makeup Hub or Makeup & Bridal Services Online Directories.’ Banners will be charged on a monthly basis. If TMB is unable to successfully charge the credit card or if the charge is refused the clients Banner, Picture Link, Hub Portfolio, Hub Portlet, Wedding Portfolio or Wedding Portlet will be removed from the themakeupbox.com website until payment has been made in full for the subscribed service.
‘Indemnity,’ TMB’S liability to the client shall not exceed the amount actually paid by applicant under this agreement.
‘Your Privacy,’ TMB will maintain client details on secure TMB servers, including but not limited to your business registration information. Clients agree TMB may use such information in aggregate form for marketing or other promotional purposes on the themakeupbox.com website for both our mutual benefit. TMB may contact you via email regarding special offers and new marketing products. Any notices or communications shall be by electronic mail. It is the clients responsibility to provide an accurate email and business address and to ensure that TMB is notified of any changes to these addresses.
‘Access and Passwords,’ as part of the subscription process a client may select a username and password in accordance with ‘Themakeupbox.com’ username and password guidelines. And agree that you are the only individual entitled to access ‘Themakeupbox.com’ website using your user name and password and you agree not to permit others to access the site using your username or password. All actions taken by you, or any other user that accesses ‘themakeupbox.com' website using your username and password, will be attributed to and legally bind you, even with respect to acts for which the user had no actual authority or made an error. ‘Copyright,’ ‘themakeupbox.com’ website contains proprietary material owned by The Makeup Box Ltd or material that other suppliers have licensed to themakeupbox.com website, both protected by copyright and other laws respecting proprietary rights. End users may view the information on screen, may download small portions of the information to a computer disk for personal convenience and later reference and may print paper copies of small portions for personal use only. The rights granted here are an expansion of the rights granted under the Copyright Act and do not include any rights to reproduce in its entirety any portion of the information or materials contained therein within this website.
No part of the information may be duplicated in any medium or format beyond the express terms of this Agreement without prior written authorization from The Makeup Box Ltd. Any use not authorized by the Agreement is prohibited. You may not permit others to: reproduce, publish, distribute, sell, or otherwise access or use any material retrieved from or contained in or on ‘themakeupbox.com’ in any manner whatsoever that may infringe any copyright or proprietary interest of the Makeup Box Ltd.
Nor decompile, disassemble, or otherwise reverse-engineer or copy themakeupbox.com website or any software contained therein, or alter, translate, modify, or adapt it to create derivative works. Unauthorized reproduction of themakeupbox.com website, transfer, and/or use may be a violation of criminal as well as civil law.
TMB reserves the right to change, modify, add or remove all or part of the Advertising Terms and Conditions Agreement at any time. TMB is not liable for any delay or failure in performance under this Agreement resulting directly or indirectly from acts of God, terrorism, or other causes beyond its reasonable control.
